LAO Submits Comments to Adult Day Service Rule 173-39-02.01

This week LeadingAge Ohio submitted comments to the Ohio Department of Aging (ODA) responding to draft rule OAC 173-39-02.01 which outlines the certification requirements for PASSPORT adult day services. LeadingAge Ohio used the opportunity to call attention to the impact that the ongoing workforce shortage is having on adult day centers and point out areas where regulations could be loosened without impacting quality of care. The three requests made include: 

  • Moving from a 1:6 staff - participant ratio to a 1:8, noting this is higher than is required in any other care setting serving elders; 
  • Instituting payment for participants who call off service or don’t show, to assist in stabilizing staffing; and
  • Lowering the first- and last-hour requirements such that when there is one participant on site, only one staff person should be present.

ODA has yet to release rules outlining waiver reimbursement rates, including PASSPORT adult day services.
