Ohio Medicaid Anti Fraud Bill Revised: What Changed for Hospice and Home Based Care
Ohio lawmakers released a revised version of HB 795 this week that significantly narrows the scope of the Medicaid anti-fraud proposal following committee testimony and stakeholder feedback. Several provisions that generated significant concern were removed, while lawmakers maintained focus on provider oversight, enrollment integrity, and fraud prevention efforts.
Changes Relevant to Hospice Providers
One of the most notable revisions for hospice providers is that the hospice specific language originally incorporated from HB 945 was removed from the substitute bill.
This means hospice oversight proposals will no longer move forward through the broader Medicaid anti-fraud package and instead will continue independently through HB 945 under the standard legislative process.
For providers, this does not mean the proposal is gone. Rather, it shifts the timeline and allows for additional committee review, stakeholder engagement, testimony, and continued refinement before any final action occurs.

The revised bill also removed language that would have prohibited family caregiving under certain Medicaid waiver programs following extensive feedback from individuals, providers, and advocacy organizations regarding access to care and unintended consequences.
Additional provisions continue to focus on Medicaid oversight and provider accountability, including:
- standardized provider onboarding requirements
- expanded ownership disclosure requirements, including disclosure of individuals with direct and indirect ownership interests
- increased provider enrollment oversight and screening activities
- additional authority for Ohio Medicaid to monitor higher risk providers
- updates impacting prior authorization, verification requirements, and program integrity activities
